The
DPL, Hyd. submitted that, the service rules for the post of Librarians in Zilla
Grandhalaya Service such as Librarian Gr.I / Dy. Librarian, Librarian Gr.II and
Librarian Gr.III were issued in G.O.Ms.No.674, Edn. Dept., dt:21.03.1967 and
certain amendments were issued to the rules issued in G.O.Ms.No.259, Edn.
Dept., dt:4.7.1988. As per these rules,
the vacancies of Librarian Grade.I / Deputy Librarian has to be filled in as
follows;
Out of
every cycle of three vacancies:
i.
The first vacancy shall be filled in by promotion
from the category of Librarian Grade.II.
ii.
The second vacancy shall be filled in by Direct
Recruitment and
iii.
The third vacancy by transfer from Senior Assistant
of the Samstha.
In
this connection, the DPL, Hyd. submitted that, in the 23 Zilla Grandhalaya
Samsthas, there are 72 sanctioned posts of Librarian Grade.I. Out of these 72, only 19 posts are existing
in 10 Zilla Grandhalaya Samsthas in the Telangana Region and the est are in the
13 Zilla Grandhalaya Samsthas in the Andhra Region,. In most of the Zilla Grandhalaya Samsthas in
the Telangana Region, there is only one post of Librarian Grade. / Deputy
Librarian. If this post goes for Direct Recruitment, then there is no chance
for promotion as well as for filling by Direct Recruitment due to ban on Direct
Recruitment.

Out
of the 72 posts, 1/3 which comes to 24 will go for promotion to the Librarians
Gr.II consisting of 153 sanctioned posts.
Thus the promotion ratio, which comes to 1:6 is very low.
In
this connection, the DPL, Hyd. submitted that, for the similar post in the
Government Libraries, to which service rules wee issued in G.O.Ms.No.721, Edn.
Dept., Dt:24.8.1982 and G.O.Ms.No.64, Edn. Dept., Dt:16.07.2002 there is no
provision for Direct Recruitment. Thus
there is disparity among the Government Libaries and Zilla Grandhalaya Samsthas
in the method of filling up of the similar cadre of posts, i.e, Librarian
Grade.I.
The
DPL, Hyd. stated that, because of the reasons that out of 72, 1/3 which comes
to 24 posts have to be filled in by Direct Recruitment and due to ban on Direct
Recruitment, more than 50% posts are vacant now. Particularly in the ZGSs in Telangana Region,
due to having only one post in the District and if said post goes for Direct
Recruitment as per cycle there is no chance to get promotion to this post and
there by the employees working in the feeder categories are becoming
frustrated. Hence, to remove the
disparity between the Government Libraries and Zilla Grandhalaya Samsthas in
the matter of filling up of the posts of Librarian Grade.I and to encourage the
employees working in the feeder category of Librarian Grade.II, it is necessary
to remove the provision of Direct Recruitment to the post of Librarian Grade.I
(Superintendent category) in the service rules.

Director of Public Libraries, Andhra Pradesh, Hyderabad while enclosing draft amendments requested
to examine the matter sympathetically and to issue necessary amendments to the
service rules issued in the G.O.Ms.No.674, Edn. Dept., dt:21.03.1967 and
certain amendments were issued to the rules issued in G.O.Ms.No.259, Edn.
Dept., dt:4.7.1988.
The
Director of Public Libraries, Andhra Pradesh, Hyderabad in her Lr.Dt:4.10.2008 submitted
that, A.P. ZGS Employees Association given indefinite strike notice from November 1st, 2008
and among other demands, Demand No.6 is for amendment to service rules for promotions to
Librarian Grade.I and Records Assistants on par with Government services.
In
view of the above, the file is submitted for orders, whether, file may be sent
to G.A.(Ser.) Department for their remarks/advice on ( ) above.

R D E R:
In
the G.O 1st read above, the service Rules for the posts of
Librarians and the Local Library Authorities in the State were issued. Subsequently, certain amendments were issued
vide reference 2nd read above.
2.
The Director of Public Libraries,
Andhra Pradesh, Hyderabad in her letter 3rd read above has stated
that the existing method of direct recruitment to the post of Librarian Grade.I
in Zilla Grandhalaya Samsthas resulted number of posts lying vacant and a
number of Libraries are running with other category of employees and there is no provision for
Direct Recruitment to the post of Librarian Grade.I in Government Libraries and
hence she has recommended to amend the service rules issued in G.Os 1st
to remove disparity between Government Libraries and Zilla Grandhalaya
Samsthas.
3. The
Government after careful examination of the matter decided to accept the above
proposal.

NOTIFICATION
In
exercise of powers conferred by sub-section (1) and clause (f) of sub-section
(2) of Section 25 of the Andhra Pradesh Public Libraries Act, 1960, (Andhra
Pradesh Act VIII of 1960), the Governor of Andhra Pradesh hereby makes the
following amendments to the Service Rules for Librarians under the Local
Library authorities issued in G.O.Ms.No.674, Education Department, dt:21.03.1967
as subsequently amended:
AMENDEMNTS
In rule 2 of the said rules, in the
Table
(i) In
coloumn (2) entry (iii) “against Category (ii) shall be omitted.”
(ii) for Note (2) the following shall be substituted,
namely,
“(2) out of
every cycle of two vacancies in Category (ii), the first vacancy shall be
filled in by promotion from category (iii) and the second vacancy shall be
filled in by transfer from Senior Assistant of the Zilla Grandhalaya Samstha.”
If no suitable
candidate is available in any method of recruitment, the vacancy may be filled
with the candidate of other method”.

The proposal in this file relates to

The G.A.(Ser.F) Dept., at para.15 ante
have requested to examined the proposal for issue of amendment to Special Rules
with reference to the existing rules and propose the amendment duly giving a
justification. After a specific view is
taken, the remarks of their Department shall be obtained. If it is finally decided by the Government
for issue of amendment, the draft order to amend the rules shall be prepared by
Education Department and it may be shown to their Department before obtaining
remarks of Law Department in the matter and the draft amendment order proposed
by the DPL, Hyd. is only for use of the Department concerned and such draft
shall not be processed without examining the issue.
In view of the above the DPL, Hyd. has
been requested accordingly, and the DPL, Hyd. has submitted her report vide
Lr.dt: 10.12.2008.

With reference to orders at para.27, a
tabulor form of existing and proposed amendment has been prepared and the
Hon’ble Minister (SSA) has approved the same.
Accordingly, a draft order is prepared
and submitted below for approval.
After approval, the same may be sent to
G.A.(Ser.F) Dept., / Law Department for their remarks and scrutiny of draft
orders.

The G.A.(Sef.F) Dept., at para.51 on
page.15 ante stated that, the draft amendments to the service rules of Zilla
Grandhalaya Samsthas issued in G.O.Ms.No.674, Edn., Dt;21.03.1967 read with
G.O.Ms.No.259, Edn.(Lib.2) Dept., dt:04.07.1988 is formally in order and
finally advised to refer
the file to the Law Department for vetting of the draft amendment and
thereafter take further action duly following the procedure as per Business
Rules ie., obtaining orders in circulations and obtaining concurrence of APPSC.
With the above position, the file may
now be sent to Law Department for vetting of the draft amendment and before
taking further action duly following the procedure as per Business Rules ie.,
obtaining orders in circulations and obtaining concurrence of APPSC, as advised
by the G.A.(Ser.F) Department at para.51 on page.15 ante.

The brief facts of the case is as under:-

It is informed that service rules for the post of Librarians in Zilla Grandhlaya

Grade-II and Librarian Grade-III were issued in G.O.Ms.No.674, Education Department, dated:21.3.1967 and amended in G.O.Ms.No.259

The Director of Public Libraries, Hyderabad,
has stated that due to ban or recruitment, in the above vacancies 98% of them
reserved for Direct Recruitment only. Most of the Librarians are running with
attenders / sweepers.
The Director of Public Libraries, Hyderabad, has further stated that in
the Government Libraries service rules issued in G.O.Ms.No.721, Education,
dated:24.8.1982 and G.O.Ms.No.64, Education, dated:16.7.2002, there is no
provision for Direct Recruitment for filling up of the posts of librarian
Grade-I. to remove the disparity between the Government libraries and ZGSs
requested the Government for issue of necessary amendment to the service rules
of ZGS.
With the above information
when the file was referred to GA (Ser.F) Department, they have informed that
the department have to examine the proposal for issue of amendment to Special
Rules with reference to the existing rules and propose the amendment duly
giving a justification. After a specific
view is taken, the remarks of GAD shall be obtained.
In view of the circumstances stated above and notice given by AP ZGS
Employees Association (demand.No.6) and as most of the Libraries are running
with attenders / sweepers, the DPL, Hyderabad, has recommended for the
following amendment to the service rules of Zilla Grandhlaya Samstha issued in
G.O.Ms.No.674, Education dated:21.3.1967 and amended in G.O.Ms.No.259 Education

On the above recommendation of DPL, Hyderabad, department have obtained
order in circulation to Hon’ble Minister (SSA) for amendment to the said rules
with regard to filling up of the posts of Librarian Grade-I by removing the
provision of Direct Recruitment similar to that of Department of Public
Libraries and placed draft amendment to the services rules of ZGS.
Accordingly, the draft orders was prepared and refer to Law Department
for vetting and the same was vetted by them, which has been faired copied now
are yet to be issue.
Keeping in view of the position above, the file may circulated to Hon’ble
Minister (MW, PE &SS), before obtaining the concurrence of APPSC in the
matter.

I am to invite your attention to the
references cited.
2. It is to
inform that in the reference 1st cited, Government have issued rules
for the posts of Librarians under the Local Library Authorities and subsequently
amended vide reference 2nd cited.
The following are the method of appointments to the post of Librarian
Grade.I:
Librarian Grade.I
(Deputy Librarians) (i)
By promotion from category (iii) or
(ii)
By transfer from the category of U.D.Cs. under Local
Library Authorities or
(iii)
By direct recruitment.
3. The Director
of Public Libraries, Andhra Pradesh, Hyderabad vide reference 5th

4. The Director
of Public Libraries, Andhra Pradesh, Hyderabad further stated that, due to ban
on recruitment, the above vacancies 98% of them reserved for Direct Recruitment

requested to issue necessary amendment to the service rules issued vide
reference 1st & 2nd cited duly removing the provision
of direct recruitment in respect of Librarian Grade.I (Deputy Librarians) post.
5. The General Administration (Service.F)
Department who were consulted in the matter have stated that the draft
amendments to the service rules of Zilla Grandhalaya Samsthas issued vide
reference 1st and 2nd cited is formally in order and
advised to refer the file to Law Department for vetting of draft amendment and
thereafter take further action duly following the procedure as per Business
Rules i.e., obtaining orders in circulation and obtaining concurrence of
APPSC.
6. Accordingly, circulation orders were
obtained for amending the service rules issued vide reference 1st
and 2nd cited for removing the provision of direct recruitment in
respect of Librarian Grade.I (Deputy Librarians) post. Consequently, Law Department has vetted the
draft amendment orders (copy enclosed).
7. In
view of the reasons mentioned above, it is therefore requested you to give
concurrence for amending the Service Rules issued vide reference 1st and 2nd
cited, for removing the provision of direct recruitment in respect of Librarian
Grade.I (Deputy Librarians) post in Zilla Grandhlaya
Samsthas, immediately.

have accorded their concurrence to amend the Service Rules for Librarians under
Local Library authority issued in G.O.Ms.No.674, Education Department, dated:21-3-1967 and as

He also informed that to quote the
Commission’s reference while issuing the G.O. and extend 10 copies of the G.O.
after issue for Commission’s Verification and record.
In this connection it is submitted that
in this case orders in circulation was already obtained at paras 69-70 on page
20 ante, thereby preparing draft order as it was vetted by the Law Department.
In view of the
position above, it is for orders, the draft order as already vetted by the Law
Department has agreed by the Secretary, APPSC, Hyderabad, which has been faired copied now
thereby adding the reference of Commission letter dated:23-09-2009, may now be issued. After issue file may be closed as G.O.
disposal.
